A serious car accident left one Milwaukee man in serious condition and three other children injured yesterday morning. The crash occurred when a van collided with a school bus around 7:30 a.m. near the corner of South Chase and Oklahoma Avenues.
According to Milwaukee police, the 50-year-old man was experiencing medical problems while driving his van, which they believe could be the cause of the accident. As a result, Police believe he was traveling at a high rate of speed which caused his van to cross the road median, hit numerous traffic signs and ultimately collide with the school bus. The driver of the van was ejected from his vehicle during impact. Currently, the driver is listed in critical condition at a local Milwaukee hospital.
Domnitz & Skemp has successfully prosecuted a similar incident wherein our client was at a stop sign when another motorist crossed the center line and struck her vehicle. In our incident, Progressive Insurance, the insurance carrier for the offending motorist, denied the claim contending that their insured had no responsibility for our client's injuries because he suffered from an "unforeseen medical condition." After putting the case into suit, however, it was abundantly clear to D&S that this individual was well aware of his condition and should not have been behind the wheel of the car on the day in question. After offering only $25,000 to settle this claim before suit, Progressive Insurance agreed to pay $325,000 after closing arguments.
Other Milwaukee motorists on the road at the time of the crash recalled that the car spun out-of-control after crossing the median and stuck the bus violently.
The identity of the man has not been released at this time.
At the time of the crash, the school bus was transporting nine children (ages 5 to 10) to Fernwood Montessori School on the 3200 block of South Pennsylvania Avenue in Milwaukee. Most of the children were unharmed in the crash except for three children that were hospitalized for minor scratches and bruises.
Principal of the school expressed that they will be keeping an eye on the children involved but they seem to be doing fine.
